Should Justice Thomas and/or Justice Kagan Recuse Themselves?

Apparently there is some controversy over whether Clarence Thomas should recuse himself from the eventual 0bamacare constitutionality SC case, because his wife is a former head of a conservative group and called the bill unconstitutional. 74 congressional Dems are saying he should recuse himself.

Orrin Hatch fired back and said that since Elena Kagan is a former member of the 0bama administration she should recuse herself.

Do either of these two need to recuse themselves?


My opinion, ideally, is no.  Both should be perfectly capable of being impartial in regards to the law.


What is interesting is that there is a growing furor on the left over the fact that Virginia Thomas has political opinions.  Somehow the fact that Justice Thomas's wife is politically active makes him ineligible to form an unbiased opinion, or an opinion biased only bu constitutional law.  Yet these same 74 Congressional Democrats are ignoring the fact that Justice Kagan was special counsel to the 0bama administration while they were forming the very law that will be coming before the Supreme Court.  If anyone has more reason to recuse, it would be Justice Kagan.


...but I will reiterate: Both should be perfectly capable of being impartial in regards to the law. I mean, they are adults, are they not?
